Provide a safe, habitable home

Your property must meet the NSW minimum standards: structurally sound, weatherproof, with working plumbing and electricity, and adequate lighting and ventilation.

Keep smoke alarms compliant

You must make sure compliant smoke alarms are installed and working. This is the landlord’s responsibility, not the tenant’s, and it is checked.

Lodge the bond correctly

Bond is capped at four weeks rent and must be lodged with NSW Fair Trading through Rental Bonds Online. You cannot hold it yourself.

Give the right paperwork

At the start of every tenancy you must provide a written tenancy agreement, a detailed condition report with photos, and the NSW Fair Trading new-tenant information statement.

Follow the rules on rent increases

Rent can generally be increased only once every twelve months, with the correct written notice. Soliciting higher offers, known as rent bidding, is not allowed.

Have a valid reason to end a tenancy

No-grounds terminations have been removed. You now need a valid reason to end a tenancy, such as selling, significant renovations or moving in, with the correct notice and supporting evidence. Confirm the current grounds and notice periods with NSW Fair Trading.

Handle pet requests reasonably

Tenants can request to keep a pet, and you can generally only refuse on reasonable grounds. Check the current process before you respond.

Arrange repairs properly

Arrange urgent repairs promptly and follow the proper process for non-urgent repairs. Delays can put you in breach of the agreement.

Respect entry and privacy

Give the required notice before entering and respect the tenant’s right to quiet enjoyment of the property.
